Terms and Conditions
Please read these Terms carefully. They explain the rules that apply when you use our website, communicate with us, or purchase jewelry and custom design services from PureArcDesign.
1. Acceptance of these Terms
These Terms and Conditions govern your access to and use of purearcdesign.com, your communications with PureArcDesign, and your purchase or use of our jewelry, custom design, consultation, and related services. By visiting the website, submitting an inquiry, creating an account, placing an order, or approving a custom design, you agree to be bound by these Terms and by the policies referenced in them.
You must be at least 18 years old, or the age of legal majority where you live, to place an order. If you do not agree to these Terms, you should not use the website or purchase our products or services.
2. Account and customer information
Account registration is optional unless a feature requires it. Whether you use an account or guest checkout, you agree to provide complete, accurate, and current information, including your name, email address, telephone number, billing information, shipping address, and any information required for an order.
You are responsible for safeguarding your account credentials and for activity performed through your account. Please notify us promptly if you believe your account or payment information has been used without authorization.
3. Products, descriptions, and availability
We make reasonable efforts to describe and display our jewelry accurately. Because screens, photography, lighting, stone characteristics, and handcrafted production can vary, actual color, scale, finish, and appearance may differ slightly from images shown online.
Diamonds and gemstones may contain natural or growth-related characteristics. Precious metal color and finish may also vary slightly. These characteristics are not necessarily defects. Product availability, stone availability, specifications, and prices may change without notice.
We reserve the right to limit quantities, discontinue a product, correct errors, or refuse an order where information is inaccurate, a product is unavailable, fraud is suspected, or the order cannot reasonably be fulfilled.
4. Custom designs and content you provide
Custom and made-to-order jewelry may require you to provide text, measurements, photographs, sketches, inspiration images, engraving instructions, or other materials. You confirm that you own these materials or have permission to provide and use them.
You grant PureArcDesign permission to review, copy, adapt, and share the materials only as reasonably necessary to design, manufacture, quality-check, and deliver your order. We will not use personal reference materials for public advertising without your permission.
You are responsible for carefully reviewing stone details, metal type and color, dimensions, ring size, engraving, spelling, CAD renderings, design approvals, and delivery information. After you approve the design or production begins, changes may be unavailable, may delay delivery, or may require additional charges.
5. Orders and order acceptance
Submitting an order does not guarantee acceptance. An order is accepted when we confirm it and, where applicable, receive the required deposit or payment. We may contact you to verify details before accepting or producing an order.
We may cancel or decline an order if payment cannot be authorized, information appears incorrect, the requested product is unavailable, the design cannot be produced safely, the request may infringe another person's rights, or fulfilling the order would violate law or these Terms.
6. Pricing, payment, taxes, and corrections
Prices are shown in the currency displayed at checkout and may change before an order is accepted. Deposits, design fees, balances, shipping upgrades, taxes, customs charges, and other applicable fees will be communicated when relevant.
You represent that you are authorized to use the payment method submitted. By completing checkout, you authorize the applicable payment processor to charge the approved amount. If a pricing, description, calculation, or payment-processing error occurs, we may correct it and will contact you if the correction materially affects your order.
Import taxes, VAT, duties, brokerage charges, and customs fees imposed by the destination country are the recipient's responsibility unless checkout expressly states otherwise.
7. Production timing and changes
Production and delivery dates are estimates. Most custom or made-to-order jewelry requires production time after all details and payment requirements are confirmed. Complex designs, sourcing requests, design revisions, holidays, quality-control work, or events outside our control may extend the timeline.
If you request a change before production begins, we will try to accommodate it. Once sourcing, CAD work, casting, stone setting, engraving, resizing, or another custom process has begun, cancellation or changes may not be possible.
8. Shipping, customs, and delivery
Orders are inspected and packaged before dispatch. Tracking information is provided when available, and higher-value packages may require a signature. You are responsible for providing a complete and accurate delivery address and for ensuring that an authorized recipient can accept the shipment.
Carrier estimates are not guarantees. Customs inspections, VAT assessment, severe weather, regional holidays, address issues, and logistical disruptions may delay delivery. Risk of loss and title transfer will be determined by applicable law and the shipping terms used for the order.
9. Returns, exchanges, cancellations, and warranty
Return and exchange eligibility depends on the product type, condition, delivery date, and whether the item was custom, engraved, resized, altered, made to order, or specially sourced. Custom and personalized items are generally final sale once production begins, except where applicable law requires otherwise or a verified quality issue exists.
Before sending any item back, contact us for review and instructions. Unauthorized returns may be refused. Additional details are provided on our Returns & Exchanges and Warranty & Care pages.
10. Promotions and discount offers
Promotional offers may be subject to dates, minimum spend, product exclusions, geographic limits, or one-use restrictions. Unless expressly stated, offers cannot be combined, applied to previous purchases, transferred, exchanged for cash, or used for taxes, duties, custom fees, or special services. We may modify or end a promotion where permitted by law.
11. Intellectual property
The PureArcDesign name, logos, jewelry designs, photographs, videos, text, graphics, website layout, software, and other content are owned by or licensed to PureArcDesign and are protected by applicable intellectual property laws.
You may view and use the website for personal, non-commercial shopping purposes. You may not copy, reproduce, republish, scrape, distribute, sell, modify, reverse engineer, train artificial intelligence systems on, or commercially exploit our content without prior written permission.
12. Prohibited uses
You agree not to use the website or our services to:
- violate any applicable law, regulation, intellectual property right, privacy right, or publicity right;
- submit fraudulent, misleading, abusive, unlawful, obscene, or harmful content;
- introduce malware, interfere with website security, attempt unauthorized access, or disrupt the operation of the services;
- collect information about other users, send unsolicited messages, or use automated scraping or data-extraction tools;
- resell, reproduce, or commercially exploit our services or content without written permission.
We may restrict access, reject content, cancel orders, or take other appropriate action when these Terms are violated.
13. Third-party services and links
Our website may use or link to services operated by Shopify, payment processors, shipping carriers, social media platforms, analytics providers, and other third parties. Their services are governed by their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control.
14. Disclaimers
To the maximum extent permitted by applicable law, the website and its content are provided on an "as available" basis. We do not guarantee that the website will always be uninterrupted, error-free, secure, or free from harmful components.
Educational content about diamonds, gemstones, metals, sizing, and jewelry care is general information and is not a substitute for an independent appraisal, professional inspection, medical advice, financial advice, or legal advice.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.
15. Limitation of liability
To the maximum extent permitted by law, PureArcDesign will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website, delay, third-party services, loss of data, or inability to access the services.
Where liability cannot be excluded, our aggregate liability relating to a product or order will not exceed the amount paid for that product or order, except where applicable law requires a different remedy or limit.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold PureArcDesign harmless from claims, losses, or expenses arising from your unlawful use of the services, your violation of these Terms, or materials you submit that infringe another person's rights.
17. Suspension and termination
We may suspend or terminate access to an account or service if we reasonably believe these Terms have been violated, fraud or security concerns exist, or continued access could harm customers, PureArcDesign, or a third party. Obligations relating to payment, intellectual property, disclaimers, liability, and dispute resolution survive termination where applicable.
18. Applicable law and disputes
These Terms and any dispute relating to them are governed by applicable law, including mandatory consumer-protection laws that apply where you live. Before beginning formal proceedings, you and PureArcDesign agree to make a reasonable good-faith effort to resolve the matter directly.
Nothing in this section limits any right or remedy that cannot be waived under applicable law.
19. General provisions
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms, together with the policies referenced here and any written order confirmation, form the agreement between you and PureArcDesign concerning the relevant services and order.
20. Changes and contact information
We may update these Terms from time to time by posting a revised version on this page. The updated version applies from the date shown above, subject to applicable law.
